Terms and Conditions for the Nailzy.com Affiliate Program

 

Welcome to the Nailzy.com Affiliate Program ("Program"). By signing up as an Affiliate, you agree to abide by these Terms and Conditions ("Terms"). Please read them carefully before participating in the Program.

 

1. Eligibility

1.1. You must be at least 18 years old to participate in the Program.

1.2. Participation in the Program is open to individuals and businesses. However, Nailzy.com reserves the right to reject applications for any reason without providing justification.

1.3. Sellers on the Nailzy.com marketplace are not allowed to participate in the Program and promote their own store.

 

2. Affiliate Responsibilities

2.1. As an Affiliate, you are responsible for promoting Nailzy.com in a lawful, ethical, and professional manner.

2.2. You must not:

• Engage in fraudulent activities.
• Use misleading or false advertising.
• Promote Nailzy.com on websites or platforms that contain illegal, offensive, or inappropriate content.

2.3. You agree to comply with all applicable laws and regulations while participating in the Program.

 

3. Affiliate Link and Tracking

3.1. Upon acceptance into the Program, you will be provided with a unique Affiliate Link.

3.2. You must use your Affiliate Link to track referrals and sales. Nailzy.com is not responsible for tracking errors due to improper use of the Affiliate Link.

3.3. You may not modify or alter the Affiliate Link in any way.

3.4. The Affiliate Link does not expire. However, once your audience clicks on the links and adds items to their cart, they must complete the purchase within 7 days for the sale to count.

 

4. Commission and Payments

4.1. Affiliates will earn a commission on qualifying purchases made through their Affiliate Link. The current commission rate is up to 5%.

4.2. Commissions are only counted for certain products, typically those shipped from our Nailzy.com warehouse.

4.3. Commissions will only be paid for completed sales that are not refunded, canceled, or fraudulent. Commissions are based on the net value of completed purchases, excluding discounts, shipping fees, and other rebates.

4.4. Payments will be processed monthly via ACH. Affiliates must provide accurate payment details.

4.5. A minimum payout threshold of $1000 must be met before payments are issued.

4.6. Nailzy.com reserves the right to adjust commission rates and payout schedules with prior notice.

4.7. Payout reports are generated on the first day of the following month. Payments are made after the 14-day return/refund period for completed orders, typically before the 10th of the month.

4.8. Commissions for fraudulent or unqualified transactions will not be paid, and Nailzy.com reserves the right to initiate chargebacks for previously paid commissions.

 

5. Intellectual Property

5.1. Nailzy.com grants Affiliates a non-exclusive, non-transferable license to use marketing materials provided by Nailzy.com solely for promotional purposes.

5.2. Affiliates may not:

• Alter or modify Nailzy.com’s trademarks, logos, or other intellectual property.
• Use Nailzy.com’s intellectual property in any manner that implies endorsement without written permission.

 

6. Termination

6.1. Nailzy.com reserves the right to terminate your participation in the Program at any time for any reason, including but not limited to breach of these Terms.

6.2. Affiliates may terminate their participation in the Program by providing written notice to Nailzy.com.

6.3. Upon termination, Affiliates must cease all promotional activities and remove all references to Nailzy.com from their platforms.

 

7. Limitation of Liability

7.1. Nailzy.com is not liable for any indirect, incidental, or consequential damages arising from participation in the Program.

7.2. Nailzy.com makes no guarantees regarding the success or earnings of Affiliates.

 

8. Modification of Terms

8.1. Nailzy.com reserves the right to update or modify these Terms at any time. Affiliates will be notified of significant changes via email or through the Affiliate dashboard.

8.2. Continued participation in the Program constitutes acceptance of the revised Terms.

 

9. Governing Law

9.1. These Terms shall be governed by and construed in accordance with the laws of the state of Texas.

9.2. Any disputes arising from the Program shall be resolved in the courts of Dallas Texas.
